Landlord DIY Bug Bombs: Chemical Laws & Tenant Rights
It is one of the most common complaints among Florida renters: You report a severe roach or bed bug infestation, and instead of hiring a licensed exterminator, the landlord hands you a $5 over-the-counter “bug bomb” (fogger) or comes into your unit and sprays store-bought chemicals themselves.
Not only do DIY foggers fail to eliminate colonizing pests—they actively make the problem worse by driving insects deep into the walls. More importantly, depending on how your lease is structured, a landlord performing DIY pest control may be committing a state crime.
OTC aerosol foggers do not penetrate cracks and crevices where German Roaches and Bed Bugs breed. Instead, they deposit a toxic film of pyrethroids across all exposed surfaces—countertops, children’s toys, and pet bowls. You have the legal right to demand a habitable environment free from negligent chemical exposure.

The Legal Thresholds of DIY Extermination
Chapter 482: Unlicensed Pest Control
In Florida, anyone applying chemicals for hire must be licensed by the Structural Pest Control Board. If your apartment complex adds a “$15 Monthly Pest Control Fee” to your rent ledger, but the maintenance man is the one spraying the baseboards with a pump sprayer from Home Depot, the landlord is operating an illegal pest control business. You should immediately file a report with FDACS.
The Failure to “Abate” the Nuisance
Even if the landlord isn’t charging a separate fee and is legally allowed to use OTC products on their own property, Florida Statute 83.51 requires them to effectively exterminate the unit. If the landlord has bug-bombed the apartment three times and the German Roaches are still breeding in the kitchen cabinets, the landlord has failed to maintain habitability. Attempting to fix the problem cheaply does not legally protect them from a 7-Day Notice of Noncompliance.
Do not let your landlord contaminate your living space with ineffective DIY aerosol foggers. Use our 7-Day Notice generator to officially document the failure of their DIY treatments and demand that a licensed Structural Pest Control Operator is dispatched to the property.
